The IN.UA domain policy

1. General provisions

1.1 The present IN.UA domain Policy is worked out by the IN.UA Domain Administrator with participation of the Internet community of Ukraine pursuant to cl.2.6 of the .UA domain Policy. The IN.UA Domain Administrator acts in compliance with cl.1.13 of the Policy of the .UA domain.

1.2. The terms and definitions used in the text of the present IN.UA Domain Policy are given in the meanings and interpretation set forth in the Policy of the .UA domain, except the otherwise provided.

1.3. The IN.UA domain is a public domain of the second level - a constituent part of the .UA domain.

1.4. IN.UA domain name(s) delegation is conducted pursuant to Article 4 of the Policy of the .UA domain.

1.5. The IN.UA domain administration features are provided for by Article 2 of the present IN.UA domain Policy.

1.6. Information concerning the IN.UA domain names delegation and administration is stored in the .UA Domain Register Database, in the format and subject to the rules provided for in Article 4 of the Policy of the .UA domain.
The IN.UA Domain Administrator maintains its own auxiliary database of IN.UA domain name delegation requests. This database provides an/the automated interface with the registrars and the .UA domain Registrar Database.

1.7 Service availability of an IN.UA domain name is checked pursuant to Article 5 of the Policy of the .UA domain.

1.8. The recommended essential conditions of the contract between an IN.UA domain name registrant and a registrar are set forth in Article 6 of the Policy of the .UA domain with due regard to cl.2.7 of the present Policy.

1.9. The recommended essential conditions of the contract between a registrar and the IN.UA domain administrator are set forth in Article 6 of the .UA domain Policy.

2. The IN.UA domain administration features.

2.1. The IN.UA domain is delegated in the interests of physical persons - the citizens and/or residents of Ukraine who independently and voluntarily identify themselves as members of the Ukrainian Internet community (see cl.2.16. of the .UA domain Policy).

2.2. In IN.UA domain one may register private domain names only.

2.3. Registrants choose the domain names at their own discretion. The domain names should consist of three or more Latin letters, numbers and the "-" character. The domain names that consist of one or two symbols shall not be registered.

2.4. An IN.UA domain name delegation request is processed within 1 (one) hour. The .UA Domain Register Database accepts a/the request to the input queue, sends the appropriate acknowledgment to the registrar (cl.2.15.6 of the .UA domain Policy) and starts processing. Within the aforesaid period the IN.UA Domain Administrator (cl.2.15.8 of the .UA domain Policy) is obliged to notify the corresponding registrar's administrative and technical contacts of the request processing course and results via e-mail.

2.5. The IN.UA Public Domain Administrator does not enter into direct relations with registrants in regard to IN.UA domain names delegation (see Cl.2.12 of the .UA domain Policy). The Administrator does not receive and process any letters, phone calls and other messages from registrants as well as it doesn't interfere in the disputes between IN.UA registrants and registrars.

2.6. The responsibility for third party rights violation during the registration or the use of an IN.UA domain name (including intellectual property rights, the right to use trademarks and so on) is borne by a/the registrant and a/the registrar pursuant to the terms of the contract they signed. If those terms are not specified in the contract the responsibility is borne by the registrar that sent the delegation request.

2.7. Domain disputes that arise from IN.UA domain names registration or use shall be resolved in the Arbitration tribunal that acts within Ukraine and was submitted ex facte in the contract between a/the complainant and a/the respondent. If a particular court was not submitted ex facto, the disputes shell be considered by the Arbitration Tribunal of the Internet association of Ukraine in accordance with its rules of procedures.

3. The procedure of giving effect to the IN.UA Domain Policy.

3.1. The present IN.UA Domain Policy comes into effect from the moment the .UA Domain Administrator and the IN.UA Domain Administrator sign the agreement in writing (see Cl.2.6.2.12 of the .UA domain Policy).

3.2. After signing the agreement with the IN.UA Domain Administrator (see cl.2.10 and Article 7 of the .UA domain Policy) a registrar starts sending its requests. The requests accumulate in registrar's separate queue in the Auxiliary registrar Database of the IN.UA Domain Administrator. The start revolver cyclical procedure starts at 12:00 AM on September 1. The requests are taken to the IN.UA input queue in turn accordingly to the date of signing the agreement.

3.3. During the start revolver procedure the .UA Registrar Database checks the syntax of each incoming request. If a new request contains the domain name that is already in the input queue the Database dismisses the new request and makes the proper record to the log. The dismissed request goes to the archive. The .UA Registrar Database starts processing the next request from the same registrar if only its queue is not exhausted.

3.4. The start revolver cyclical procedure ends then the .UA Registrar Database states that the queues of all registrars are exhausted. The log of the procedure moves to the archive.

3.5. After the start revolver procedure is over the .UA Registrar Database sends e-letters to the registrars whose domain name requests have been discarded.

3.6. The IN.UA Domain Administrator dispatches the start revolver cyclical procedure log at the request of more than 50% of registrars or by the court order (see Article 9 of the .UA domain Policy).

3.7. After the start revolver cyclical procedure is over the IN.UA domain name delegation requests are sent to the common input queue in the order of their receipt in conformity with cl.2.4. of the .UA domain Policy. The requests are processed in the order provided for by the present Policy and the .UA domain Policy.

3.8. The simultaneity period for IN.UA domain name delegation requests is not established. The exception can be made only under conditions mentioned in Cl.3.2 and 3.3 of the present Policy.
